Trade terms of sale

1. Scope

These terms apply only to businesses and professionals with a company or VAT number who buy to resell or to use in their activity. Consumer protection rules do not apply.

2. Account approval

The trade account is activated once Banbroken approves the application. Banbroken may decline or withdraw an account if the details are incorrect or these terms are breached. You sign in with your email and a one-time code, without a password.

Accounts with no order within 10 days of activation become inactive and can be re-applied for at any time.

3. Prices and taxes

All prices are shown excluding VAT and duties and correspond to your membership level. Card payment fees are already included in the price. Prices may change with 30 days' notice; orders already paid keep their price.

Taxes are applied at checkout according to the tax regime stated in your application:

  • With VAT (mainland Spain and Balearic Islands): current VAT (21%) is added.
  • With VAT and equivalence surcharge: the applicable surcharge (5.2%) is also added.
  • VAT-exempt, EU business: exempt intra-community supply, only with a VAT number valid in VIES (reverse charge).
  • VAT-exempt, export (Canary Islands, Ceuta, Melilla and outside the EU): import taxes (IGIC, IPSI, duties and local VAT) are paid by the recipient.

4. Membership levels and minimum order

  • SILVER (boxes, gyms and clubs): minimum order €250.
  • GOLD (stores): minimum order €500.
  • PLATINUM (wholesalers and distributors): minimum order €1,500.

Amounts excluding VAT. Banbroken assigns the level when approving the account based on business type and purchase volume, and upgrades it automatically when your cumulative purchases exceed €1,500 (GOLD) and €6,000 (PLATINUM). The cart does not allow payment below your level's minimum.

5. Payment

In advance, by card at checkout. Bank transfer is only available to repeat customers enabled by Banbroken, and is also paid before shipping.

6. Shipping

Charged according to the order's billable weight (the greater of actual and volumetric weight) and the destination zone, as shown at checkout. Mainland Spain and Portugal: 24–48 working hours from dispatch. Outside the EU, shipping is DAP: import duties and taxes are paid by the recipient.

7. Delivery check

Check the parcels on arrival and note any damage on the carrier's delivery note. Shortages or damage must be reported within 48 h, with photos.

8. Returns

Trade purchases carry no right of withdrawal and no returns for unsold stock. Returns or exchanges are accepted only for manufacturing defects reported within 15 days of receipt; in that case Banbroken pays shipping.

9. Invoicing

Invoices are issued to the company name and tax/VAT number given in the application.

10. Brand and images

You may use Banbroken photos, videos and copy to sell its products, without altering them. Selling on marketplaces (Amazon, Wallapop, Miravia or others) requires prior written authorisation. The retail price is a recommendation.

11. Data

Processed under the privacy policy, only to manage the account and orders and, if you agree, to send you trade news.

12. Law and jurisdiction

Spanish law. Courts of Málaga.
